GENERAL TERMS AND CONDITIONS OF Zenstay B.V. (REGISTERED WITH THE DUTCH CHAMBER OF COMMERCE, “Hotel Zenstay” and /or “Hotel Zenstay Zaandam”, and/or “Zenstay Zaandam” ).

1. Definitions and Interpretation
1.1. In these Terms and Conditions, unless the context otherwise requires, the following expressions have the following meanings:

Customer: The natural person(s) to whom one or more hospitality services must be provided by Zenstay at a price payable by the Customer.

Zenstay: Zenstay B.V., the location to which the reservation applies.

Rates: The prices payable for rooms and (where applicable) other facilities offered by Zenstay.

No Show: A guest not arriving at the hotel on the date of arrival of their reservation without prior notice to Zenstay.

2. Bookings and Reservations
2.1. Customers may make reservations in advance through Zenstay’s website or third-party booking websites on which Zenstay is advertised.

2.2. Customers are required to provide identification (passport or driver’s licence) and information including, but not limited to, their name, address, contact telephone number, nationality and email address. In case no authorised credit card can be presented, Zenstay reserves the right to deny entry to the hotel.

2.3. Customer shall pay the reservation in full at least 48 hours prior to arrival.

2.4. Reservations booked in advance do not constitute a legally binding contract between Zenstay and the Customer until Zenstay confirms the reservation with the Customer and provides the Customer with a booking reference.

2.5. The Customer may request a change to his/her reservation at any time prior to arrival (subject to the cancellation provisions set out in Clause 4 below). Zenstay will use all reasonable endeavours to accommodate any changes requested but gives no guarantee that all changes can be accommodated.

2.6. Reservations are not required. Customers may make bookings on arrival; however, Zenstay cannot guarantee the availability of rooms or other facilities for such bookings.

2.7. Customers may request additional nights at Zenstay at any time during their stay. Zenstay will use all reasonable endeavours to accommodate such requests.

2.8. For reservations for groups of more than 6 persons, Customer is required to send an email to Zenstay for the request of a group reservation. Zenstay will then verify whether such reservation is possible. If separate reservations are made resulting in a group larger than 6 persons, Zenstay holds the right to refuse such a group upon check-in.

2.9. Zenstay reserves the right to reject requests for reservations or cancel them if it has proof that, due to the characteristics of the Customer or the intended use of the reservation, it is morally justified to refuse the request for reservation based on widely recognised and accepted ethical values and human rights.

3. Fees and Payment
3.1. Details of Rates including, where applicable, promotional Rates and other special offers are available on Zenstay’s website.

3.2. Rates and prices quoted when making reservations only apply to accommodation unless otherwise stated. Additional charges may apply including, but not limited to, city tax, food, drinks and other services Zenstay might be offering. These additional charges are to be paid on the spot.

3.3. Zenstay may from time to time offer promotional Rates. The following provision applies:

3.3.1. Additional nights requested under sub-Clause 2.7 above shall be charged at the standard published Rate.

3.4. Zenstay may offer non-refundable Rates. The following provisions apply:

3.4.1. Advance payments made under sub-Clause 3.4 above are non-refundable.
3.4.2. Any deposits or booking fees paid at the time of reservation are non-refundable.

3.5. The following payment methods are accepted by Zenstay:

Credit Cards – Visa, Mastercard

Debit Cards – Maestro, Vpay

Cash payments are not accepted
3.6 City Tax
Please note that a mandatory city tax applies to all reservations. This tax is not included in the room rate and must be paid upon arrival during the check-in process at the self-service kiosk, prior to receiving the room key.

The applicable rate is determined by the municipality of Zaanstad and may change over time. The most current and updated information regarding the amount of city tax can always be found on the official government website:

4. Cancellations
4.1. Subject to sub-Clause 4.2 below, reservations may be cancelled if the Customer gives notice 48 hours before arrival (local time) of their reservation, only if the reservation does not exceed the amount of 2 nights.

4.2. In the event that the Customer has paid in advance under the provisions of sub-Clause 3.4, no refunds shall be made in the event of cancellation.

4.3. Failure to provide the required notice of cancellation shall result in the Customer being charged for their full stay.

4.4. In case of a No Show the Customer is charged for their full stay. No refund will be provided.

4.5. In case of a No Show the subsequent nights, if any, will be cancelled. Therefore, the Customer must inform Zenstay if he/she is delayed getting to Zenstay.

4.6. Zenstay may, in an exceptional case, cancel a reservation. In the event of such cancellation, the Customer shall be informed immediately and shall be offered a full refund of any and all sums paid.

5. Check-in and Check-out
5.1. Customers can check-in at Zenstay from 14:00 via self-check-in instructions provided.

5.2. Check-out time at Zenstay is 11:00. Failure to check-out by this time may result in the Customer being charged for an additional night’s accommodation at the standard applicable Rate.

5.3. Access codes are provided during the check-in process, giving the Customer access to their reserved room. Customers are responsible for keeping their codes private and secure.

5.4. Only Customers with a valid reservation are allowed to enter Zenstay.

5.5. Cleaning services are not provided daily. Rooms are cleaned only upon request and may be subject to an additional fee.

5.6. Luggage storage is not available unless explicitly arranged in advance.

6. Hotel Rules
6.1. Customers are required to always behave in a reasonable and responsible manner when staying at Zenstay and must not act in any way which may disturb other guests. Any Customer who, in the opinion of staff or management, disrupts the comfort, safety or security of other guests or residents is required to leave the premises immediately and will not be given a refund.

6.2. Customers shall be charged for any and all damage caused by them to Zenstay’s property during their stay.

6.3. Smoking traditional and electronic cigarettes is not permitted in any indoor area of Zenstay. Failure to adhere will result in a minimum penalty charge of €400 and immediate removal from the property.

6.4. No animals are allowed in Zenstay, unless explicitly agreed in advance.

6.5. Any Customer found using illegal drugs within Zenstay will be asked to leave the premises immediately. A refund will not be issued.

6.6 Mandatory Mid-Stay Cleaning- For reservations longer than 14 consecutive nights, Zenstay reserves the right to enter the room to perform a mandatory cleaning service on the 14th day of the stay. This ensures the room remains in good condition and meets hygiene standards. Guests will be informed in advance of the scheduled cleaning.

7. Food and Drinks
7.1. Unless expressly indicated otherwise, food and drinks are not included in any Rates and will be charged separately.

8. Limitation of Liability
8.1. To the fullest extent permissible by law, Zenstay’s liability for any loss or damage suffered by Customers shall be limited to that which arises out of the negligence of Zenstay’s employees, subcontractors or agents.

8.2. Zenstay shall not be liable for any indirect loss or damage including, but not limited to, loss of income, loss of business, loss of profits, loss of opportunity, loss of anticipated savings, loss of data or lack of enjoyment.

8.3. Zenstay shall not be liable for damage to or loss of goods brought to Zenstay by a Customer. The Customer indemnifies Zenstay against claims in connection therewith, except in cases of intent or gross negligence by Zenstay.

8.4. Liability of Zenstay is limited to the amount that can within reason be insured.

9. General
Zenstay may, from time to time, change these Terms and Conditions without notice, however it will use its reasonable endeavours to inform Customers as soon as is reasonably possible of any such changes.

10. Data Protection
Zenstay processes personal data in accordance with the current legislation (the “GDPR”). Zenstay refers to its privacy statement.

11. Force Majeure
11.1. Every circumstance that hinders the implementation of the agreement between Zenstay and the Customer such that the agreement becomes impossible or burdensome (such as natural disasters, flooding, etc.) shall be qualified as force majeure.

12. Lost and Found
12.1. Objects lost or left behind at Zenstay must be reported immediately to management.

12.2. Zenstay acquires the title of objects of which the rightful owner did not report within one year.

12.3. If Zenstay sends objects left behind to the Customer, this shall take place entirely at the risk and expense of the Customer.

13. Law and Jurisdiction
13.1. These Terms and Conditions shall be governed by, and construed in accordance with, Dutch law.

13.2. Any dispute, controversy, proceedings or claim between the Parties relating to these Terms and Conditions shall fall within the jurisdiction of the courts of The Netherlands.

13.3. The invalidity of one or more provisions shall not affect the validity of all other provisions.
